This decision, made by Chief Justice of India (CJI) Surya Kant, aims to streamline judicial operations and enhance the efficiency of the court system.
The current protocol involves the CJI, who serves as the master of the roster, in assigning cases to various benches. However, a recent internal review revealed significant issues within the registry that prompted this shift towards automation. The analysis indicated that prolonged tenures of certain officials in their positions, along with an outdated technological framework, have led to irregularities in case allocations.
The findings of the internal review were brought to light during proceedings presided over by the CJI, along with Justices Joymalya Bagchi and Vipul Pancholi. The bench was addressing a petition that challenged provisions of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, citing conflicts with the Bharatiya Nyaya Sanhita, 2023.
During the hearings, the Uttar Pradesh government informed the court that a similar challenge had already been dismissed by a three-judge bench in December 2022. Despite this, a new petition managed to appear on the cause list before a different bench, drawing the ire of CJI Kant. Although Senior Advocate Shoeb Alam sought to withdraw the plea, the CJI insisted the matter remain before the court for resolution, indicating a desire for thorough administrative scrutiny moving forward.
Earlier this week, Chief Justice Kant reiterated the Supreme Court's dedication to utilizing AI technology to improve the legal system's efficacy. The CJI highlighted that the apex court's research center has been revitalized specifically to tackle the root causes of the backlog in cases.
In his remarks, CJI Kant stated, "We are making the optimistic, positive, and constructive use of AI. To this end, we have established a dedicated committee—the Supreme Court's AI Committee. Our goal is to maximize AI's potential for delivering swift, affordable, and just outcomes."
The Supreme Court's focus on AI is not entirely unprecedented; the court has recently commended the Case Management System (CMS) developed by the Kerala High Court, which has been recognized as a leading example of digital transformation within the judiciary. The Kerala High Court's CMS has made it India's first fully digital and paperless court system, showcasing innovative technological advancements since its inception in 2019.
