Bihar CM Nitish Kumar can legally remain in office for six months after being elected to the Rajya Sabha, as Minister Sharwan Kumar confirms. What’s next for Bihar?
GlipzoIn a significant announcement on March 20, 2026, Bihar's Rural Development Minister Sharwan Kumar confirmed that Chief Minister Nitish Kumar can legally hold his position for the next six months, even after his recent election to the Rajya Sabha. This news comes at a crucial time as discussions intensify regarding Kumar's potential successor for the Chief Minister role.
Minister Kumar emphasized that despite his new responsibilities as an MP, Nitish Kumar is not required to vacate his Chief Minister position immediately. "He can resign from his Legislative Council seat within 14 days, but he can remain the Chief Minister for the stipulated six-month period as per constitutional provisions," he stated. This unique scenario arises from the Prohibition of Simultaneous Membership Rules, 1950, which mandates that elected officials must resign from their state legislature seat upon being elected to Parliament. Failure to do so within the 14-day timeframe results in a vacancy in Parliament.
The legal framework surrounding this situation is rooted in Article 101 and Article 164(4) of the Indian Constitution. While the first article prohibits simultaneous membership in both Parliament and the State legislature, the latter allows for an individual to serve as Chief Minister or Minister for a period of up to six months without being a member of the State legislature. This means that Nitish Kumar can continue leading Bihar while navigating his new responsibilities in the Rajya Sabha.
Amidst this political backdrop, speculation is rife regarding who will take over the Chief Minister's role once Kumar steps down. When asked about the prospects of Samrat Choudhary, the current Deputy Chief Minister and a member of the Bharatiya Janata Party, being a frontrunner for the position, Sharwan Kumar responded, "I've heard his name mentioned just like everyone else. Ultimately, the decision will be made by our senior leaders."
During the ongoing Samriddhi Yatra, a program initiated by Kumar to review state schemes and engage with citizens, hints have been dropped regarding Choudhary’s potential ascension. When pressed on when a decision about the new Chief Minister would be made, Sharwan Kumar, a close ally of Nitish Kumar, mentioned that it could happen either this month or next. "The current term of the Rajya Sabha member expires on April 9, after which Nitishji will take the oath. Only then will the decision regarding the formation of the new government be finalized," he explained.
Adding to the speculation, on March 19, Union Minister Jitan Ram Manjhi publicly supported Choudhary as a suitable candidate for Chief Minister during an Iftar party. He remarked, "Nitish Kumar is transparent in his decisions. If he indicates a preference for a leader, it’s likely he will follow through. I believe Samrat Choudhary is a strong contender for the Chief Minister position."
The Samriddhi Yatra, which aims to assess development projects and connect with the populace, concluded its fourth phase on the same day as Sharwan Kumar's announcement. This phase involved visits to eight districts across Bihar, allowing Nitish Kumar to gather feedback on various initiatives. The next phase of this outreach is set to commence on March 23, with Kumar starting off from Jehanabad and covering several districts, including Arwal, Kaimur, Rohtas, Buxar, Bhojpur, and his home district, Nalanda, before wrapping up in Patna on March 26.
As Kumar continues his tour, he remains focused on reviewing ongoing development projects in regions like Gaya and Aurangabad. This engagement not only helps in assessing the projects but also strengthens his connection with the electorate, which is crucial as he prepares for a potential transition of power.
The coming weeks are pivotal for Bihar's political future. As Nitish Kumar prepares to take his oath in the Rajya Sabha and subsequently announce his successor, the dynamics within the Janata Dal (United) and its alliances will be scrutinized closely. The speculation surrounding Samrat Choudhary’s rise highlights the ongoing negotiations and power plays within the state's political framework.
As we approach April, all eyes will be on the developments that arise from these changes. The decisions made by Nitish Kumar and his party leadership will not only shape the future of Bihar but could also influence political strategies in other states. Anticipation for the announcement of the new Chief Minister and the implications it carries for governance and party dynamics will be a focal point for analysts and voters alike in the coming months.
In summary, while Nitish Kumar's leadership period may extend for another six months, the question of succession is looming large. The forthcoming weeks will reveal how these political maneuvers play out and what they mean for Bihar's governance and public sentiment in the long run.
